The rate is the last trade on Bybit ETHUSDT spot. A real trade fills at the order book's bid or ask, which sit either side of the last price, and adds the platform's fees. Prices move between reading and trading, too.
Why can USDT trade above or below one US dollar?
USDT is a token issued by Tether, and on markets it trades at whatever buyers and sellers agree — usually within a fraction of a cent of $1, further away when markets are stressed or redemptions are in doubt. CoinGecko currently prices it at $0.9992. So ETH's value in USDT and in dollars are two different figures: this page shows the USDT one, and the ETH to USD converter converts it at Tether's market price rather than treating the two as equal.
